Battery law does not affect manufacturers alone. New- and used-parts traders, workshops, importers and recyclers may have duties depending on their role. Since 2025, the directly applicable EU Batteries Regulation and Germany's BattDG form the central framework. The first step is to identify the battery category and market role in each transaction.
Clarify roles and battery categories before sale
- Keep manufacturer, importer, authorised representative, trader, distance seller and waste operator as separate roles.
- Do not combine starter, industrial, EV, portable and light-means-of-transport batteries in one generic class.
- For new batteries, check registration and the responsible economic operator in the supply chain.
- For used or remanufactured batteries, clarify product status, SoH, safety, origin and potential new producer responsibility.
Trader take-back workflow
- Document the range and resulting take-back categories.
- Organise free return in or near the retail premises.
- For distance sales, provide suitable return options within reasonable distance of the end user.
- Assess and secure damaged, suspicious and undamaged batteries separately on receipt.
- Transfer returns only to authorised producer-responsibility organisations or selected waste operators.
- Record quantities, category, handover, recipient and customer information.

Must German parts traders take back waste EV batteries?
Section 18 BattDG defines trader duties limited to the stated categories sold or previously sold as new batteries. The individual case and additional EU requirements must be checked.
Does this apply to online sales?
Yes. Germany's BattDG requires suitable return facilities within a reasonable distance of the end user for distance contracts.
Can a returned battery be sold again immediately?
Not merely because it was returned. Waste status, safety, lawful route and any preparation-for-reuse or remanufacturing requirements must first be resolved.
